1. Services

Viva Landscape & Design provides professional landscaping, hardscaping, and outdoor living services in the Phoenix metropolitan area. Our services include but are not limited to:

• Artificial turf installation
• Natural sod installation
• Paver patios, walkways, and driveways
• Decorative rock and xeriscaping
• Irrigation and sprinkler systems
• Desert planting and tree installation
• Retaining walls
• Fire pits and outdoor living spaces

2. Estimates and Pricing

All estimates provided by Viva Landscape & Design are based on information available at the time of assessment. Final pricing may vary based on:

• Changes in project scope or materials
• Unforeseen site conditions
• Customer-requested modifications
• Material price fluctuations

Written estimates are valid for 30 days unless otherwise specified. A signed contract and deposit are required to begin work.

3. Payment Terms

• A deposit is required to schedule work and secure materials
• Progress payments may be required for larger projects
• Final payment is due upon project completion
• We accept cash, check, and major credit cards
• Late payments may be subject to interest charges

4. Scheduling and Access

The customer agrees to:

• Provide clear access to the work area
• Ensure pets and children are kept away from the work site
• Remove personal property from the work area
• Mark or identify underground utilities, sprinkler lines, and other obstructions

Work schedules may be affected by weather conditions, material availability, or other factors beyond our control.

5. Warranties

Workmanship Warranty

We provide a workmanship warranty on our installations as specified in your contract. This warranty covers defects in installation and labor.

Material Warranties

Material warranties are provided by the manufacturers and vary by product. We will assist you in processing any warranty claims for materials we install.

Plant Warranty

Plants are warranted for a period specified in your contract, provided proper watering and care instructions are followed. Plant warranties do not cover damage from drought, frost, pests, or neglect.

6. Limitations of Liability

• We are not responsible for damage to unmarked underground utilities or irrigation lines
• We are not liable for pre-existing conditions or damage to adjacent property not covered in the scope of work
• Our liability is limited to the contract amount for the specific work in question

7. Cancellation Policy

If you wish to cancel a scheduled project:

• Cancellations made 7+ days before scheduled start: Full deposit refund minus any materials already ordered
• Cancellations made less than 7 days before start: Deposit may be forfeited
• Cancellations after work has begun: Payment required for all completed work and materials

8. Intellectual Property

All content on our website, including text, images, logos, and designs, is the property of Viva Landscape & Design and is protected by copyright law. You may not reproduce, distribute, or use our content without written permission.

9. Website Use

By using our website, you agree to:

• Provide accurate information when submitting forms
• Not use the website for any unlawful purpose
• Not attempt to interfere with the website's operation

10. Governing Law

These Terms & Conditions are governed by the laws of the State of Arizona. Any disputes shall be resolved in the courts of Maricopa County, Arizona.
